Terms & Conditions

1. What Afterwords Is

Afterwords is a digital vault and scheduled message delivery service. It is not a legal document service, an escrow service, or a substitute for a will, trust, or estate plan. Your Afterwords vault stores personal messages you create during your lifetime and delivers them to designated recipients on a schedule you define.

Afterwords is not a law firm and does not provide legal advice. The optional WillVana estate planning consultation included with your membership is provided by Barker Richardson, PLLC, a licensed North Carolina law firm, and is subject to a separate engagement agreement.

Not a will. Afterwords messages are personal communications only and shall not be construed as a will, codicil, holographic will, trust amendment, or any other testamentary document under the laws of any jurisdiction. No Afterwords message, recording, transcript, or delivery shall constitute a legally binding disposition of property or estate directive. If you intend to direct the disposition of your assets, you must execute a valid legal will or trust through a licensed attorney.

2. The Service — What We Promise

As a founding member, Afterwords provides:

Service continuity: Afterwords is a pre-launch product. While we are committed to delivering this service, we are a startup. In the event Afterwords ceases operations, we will provide at least 90 days' notice to all members and will deliver all pending messages to your designated recipients before shutdown. Your vault contents will be made available to you for download.

3. What We Do Not Promise

Afterwords does not guarantee:

We are not responsible for messages that cannot be delivered due to invalid recipient information you provided.

4. Your Vault — Privacy & Encryption

Your messages are stored encrypted. LawVana personnel do not read your vault contents. Your messages are processed by AI solely to assist in shaping them into deliverable form during your session — this processing occurs at session time and is not retained for training or any other purpose.

You retain all rights to the content you create. Afterwords claims no license to use your personal messages for any purpose other than the delivery services described here.

5. Message Authentication & Timestamp Record

Every message delivered through Afterwords includes a permanent authentication block identifying: (a) the subscriber's first name, (b) the date and time the message was recorded, (c) the date and time of delivery, and (d) a unique Afterwords Message ID. This block appears on every delivered message as follows:

This is a personal communication. It is not a legal will or estate document.

Afterwords maintains a secure log of all recording sessions and deliveries, including timestamps, for the life of the account. This log constitutes the chain of custody for each message and may be used to establish the authenticity and timing of any communication in the event of a legal dispute. By subscribing, you consent to this logging and authorize Afterwords to produce this authentication record in response to a valid court order.

6. Law Enforcement & Subpoenas

By subscribing to Afterwords, you acknowledge and agree to hold harmless LawVana™, Afterwords, and their principals, employees, and agents from any and all liability whatsoever arising from or related to any subpoena, court order, or other legal process issued by any law enforcement agency, court, or governmental authority concerning your vault contents or account information. Afterwords expressly reserves the right to comply with any valid court order without further notice to you or your estate.

7. Death Verification, Delivery Triggers & Lifetime Definition

"Lifetime access" means the period from your enrollment date through the earlier of: (a) your natural death, or (b) your 99th birthday. Subscribers who reach age 99 without triggering delivery will be contacted by Afterwords to renew, update their vault, or designate a successor vault administrator. Afterwords reserves the right to archive inactive vaults after age 99 with 90 days' prior written notice.

Delivery is triggered by the following three-tier protocol, applied in order:

Afterwords does not monitor obituaries, social media feeds, government death registries, or commercial death-notification services. The three-tier protocol above is the exclusive basis for delivery.

False triggers. If delivery is triggered in error — due to subscriber incapacity, hospitalization, travel, or technical failure — Afterwords' liability is limited to reasonable efforts to halt undelivered messages. Messages already sent cannot be recalled. This limitation is a material term of this agreement and a condition of the introductory pricing offered.

You must inform your trusted contact of their designation and their responsibilities. Failure to do so is not Afterwords' liability.

8. Payments & Refunds

The founding member fee of $349 is a one-time payment. It is non-refundable after your Afterwords Session has been conducted. If you request a refund before your session, we will refund the full amount within 10 business days.

Your founding member rate is locked for the life of your membership as defined in Section 7. We will never charge you a higher rate for the services included in your founding membership prior to age 99.

9. Limitation of Liability

To the maximum extent permitted by applicable law, LawVana's total liability for any and all claims arising from the Afterwords service is limited to the amount you paid for your membership ($349 for founding members). We are not liable for indirect, incidental, special, or consequential damages of any kind, including emotional distress, arising from failed, delayed, or erroneous message delivery.

All claims must be brought within one (1) year of the date the alleged failure of service occurred. Claims not brought within this period are permanently waived. This limitation is a material term of this agreement and a condition of the introductory pricing offered.

We take this responsibility seriously. We simply cannot accept unlimited liability for a service that, by design, extends across years or decades and depends substantially on factors outside our control — including the accuracy of recipient contact information, the availability of email infrastructure, and the actions of your designated trusted contact.

10. Governing Law & Venue

This agreement is a contract for services provided over the internet. The parties acknowledge and agree that the exclusive venue for any dispute arising from or related to this agreement or the Afterwords service shall be Wake County, North Carolina, USA, and these Terms shall be governed by the laws of the State of North Carolina.

11. Changes to These Terms

We may update these Terms. If changes are material, we will notify you by email at least 30 days in advance. Your continued use of the service after that date constitutes acceptance. If you do not accept material changes, you may cancel your membership and receive a pro-rated refund of unused vault storage fees, if applicable.
